Superior Administrative Court of Ukraine declared invalid the presidential decree by the ex-President Viktor Yushchenko on awarding Bandera the title of Hero of Ukraine

According to information from the presidential press service of Ukraine, Superior Administrative Court of Ukraine declared invalid the presidential decree by the ex-President Viktor Yushchenko on awarding Bandera the title of Hero of Ukraine.

In addition, the same judicial instance today on Wednesday will consider a claim of Donetsk lawyer Vladimir Olentsevich for the abolition of the Decree by Viktor Yushchenko on awarding the Commander-in-Chief of the UPA Roman Shukhevych the title of Hero of Ukraine. The statement of the press service says that any decision will be final and inappealable.

“The claim will be considered on the merits, no documents are requested, it is only necessary to hear and adopt a decision. I think it will be ready on Wednesday. Another question – what it will be,” said Vladimir Olentsevich. According to Donetsk lawyer, only a sitting president is entitled to oppose him in the Superior Administrative Court of Ukraine . “But when the Bandera action was brought before the court, the administration asked to consider it without its participation. I think it will be so now,” said Olentsevich.

For his part, head of Kyiv municipal organization of “Freedom” Andrey Mohnyk said that a descendant of Roman Shukhevych, Jury will be present in court. “His lawyers will fight. But even if the case goes against Shukhevych he will not cease to be a hero for the Ukrainians,” Mohnyk believes.

The Commander-in-Chief of the UPA Roman Shukhevych was awarded the title of Hero of Ukraine in 2007; two years later Yushchenko awarded with the same title the leader of the Organisation of Ukrainian Nationalists Stepan Bandera. Furthermore, let us recall that Lviv, Ivano-Frankivsk and Ternopil awarded Bandera and Shukhevych the title of honorary citizens.

Immediately after his election to the highest office of Ukrainian state, Party of Regions leader Viktor Yanukovych said that he intends to strip Bandera and Shukeyvich of their titles of Hero. President Viktor Yanukovych explained his decision by an ambition “so that in the future in our country there will never be questions of rewriting history.”

The lawyer Olentsevich’s arguments are interesting because they are based on the paradox: sonorous titles of “Heroes of Ukraine” are awarded to the people who had never been citizens of this state.

Last April Donetsk Regional Administrative Court at first declared illegal and abolished the decree by Victor Yushchenko on conferring the title of Hero of Ukraine to Stepan Bandera, and then stripped Roman Shukhevych of this title.
