Messrs. Khodorkovski and Lebedev to Get 10 Years

of General Regime Each

Prosecutor Dmitri Shokhin demanded 10 years of imprisonment at a general regime colony for each, ex-head of Yukos Mikhail Khodorkovski and ex-head of MFO MENATEP Platon Lebedev. The State Prosecution insists on depriving the accused of the right to hold jobs at state and local self-government bodies during three years after their release.

The prosecutor demanded that the court should sentence Andrei Krainov, the third man to appear in court, to five and a half years conditionally, with probation term of five years, for having collaborated with the investigation.

In his statement D. Shokhin specifically noted that M. Khodorkovski and P. Lebedev denied to acknowledge their guilt, which characterized them negatively as individuals. Their guilt is aggravated by their having committed the crimes as a group, said the prosecutor.

At the same time, the prosecution asked the court to withdraw the charge of fraudulence against M. Khodorkovski and P. Lebedev in respect of the "Apatite" affair, due to the maturity of the term specified by the statute of limitation.
